Where the sales come from in South Dakota

Every deed for a sale must come with a certificate of value that states the actual price paid. The certificate also names the buyer and seller, any relationship between them, and the terms of payment if the price isn't paid in full at the sale, and no register of deeds may accept the deed without it (SDCL 7-9-7). The register of deeds passes it to the county director of equalization and the state Department of Revenue. The seller also pays a transfer fee based on the value when the deed is recorded.

Real estate transfer fee: "fifty cents for each five hundred dollars of value or fraction thereof upon the privilege of transferring title to real property", paid by the grantor (SDCL 43-4-21)

South Dakota has 66 counties. Property Scan covers any of them, pulled on demand.

Every comp in a Property Scan report is a closed sale with a recorded price, adjusted for market time with the FHFA House Price Index for South Dakota, which rose 1.1% in the four quarters to the second quarter of 2026 (how comps are chosen and adjusted).

Pricing opinions under South Dakota rules

South Dakota law treats "broker price opinion" and "comparative market analysis" as the same thing: an estimate of probable selling or leasing price, prepared by a licensed broker or salesperson. It is not an appraisal, and it does not include an automated valuation model. The Commission's guidance adds that a BPO/CMA should talk about "price", not "value", and that such reports must be kept for 4 years (SDCL 36-21A-74).

“For the purposes of this chapter, the terms, broker price opinion and comparative market analysis, mean an estimate prepared by a licensed broker or salesperson that details the probable selling price or leasing price of a particular parcel of or interest in real property and provides a varying level of detail about the property's condition, market and neighborhood, and information on comparable properties, but does not include an automated valuation model. A broker price opinion or a comparative market analysis is not an appraisal.”
SDCL 36-21A-12.2 (SL 2013, ch 178, § 1); see also SD Real Estate Commission guidance "Distinctions between Broker Price Opinions, Comparative Market Analyses, Evaluations, and Appraisals"

Every Property Scan report says it's a comparative market analysis, not an appraisal. Not legal advice.
